Van Halen Settle With Alex Van Halen’s Former Wife Over Name

A pending lawsuit brought by the group Van Halen against drummer Alex Van Halen’s ex-wife, Kelly, has been dropped.

The two were divorced in August of 1996 but Kelly continued to use her famous last name on her construction and interior design companies and tried to get a trademark on the Kelly Van Halen name for a number of products and services that she owned or endorsed.

ELVH, Inc., the company that handles the band’s name, took issue with the her continuing to use the Van Halen name almost twenty years after the divorce. They filed a lawsuit in October 2013 and, in papers submitted to the court last March, questioned whether her use of the Van Halen name “diluted” the band’s name or reputation.

On Friday, the Hollywood Reporter said that the two parties had come to an amicable agreement in settling the issue. Daniel DeCarlos told the site that Kelly can continue to use the Van Halen name but must stay away from any music-oriented products that might impede on the band’s business. She also must use identifying language such as “Designer Original by Kelly Van Halen” on her products and services.
