Kim Davis, the Kentucky county clerk who was released today after spending a week in jail for refusing to issue marriage licenses to gay couples, emerged from the courthouse to the strains of Survivor’s Eye of the Tiger and member Frankie Sullivan is none too happy.

Sullivan went on Facebook shortly after Davis’ release to express his dissatisfaction with both the clerk and presidential candidate Mike Huckabee who has been supporting her throughout her incarceration.

NO! We did not grant Kim Davis any rights to use “My Tune -The Eye Of The Tiger.” I would not grant her the rights to use Charmin!

C’mom Mike, you are not The Donald but you can do better than that –

A writer for TMZ wrote a message in the stream after the original message asking Sullivan to contact her. A story followed shortly after on the site saying that a rep for Survivor said they would be protecting the integrity of the music. While they didn’t say it specifically, the site implied that a possible lawsuit is being examined.

Over the last few years, a number of different artists, including John Mellencamp and Neil Young, have gone on the offensive after a politician has used their music as part of their campaign, either in personal appearances, in YouTube videos or on television advertising.

Survivor was formed in Chicago in 1978 by Jim Peterik, former lead singer for the Ides of March, and Gary Smith and Dennis Keith Johnson who had played in the group Chase. Sullivan joined soon after and, in 1980, the band’s debut album was released. Two years later, they hit the top of the charts with Eye of the Tiger, which was used as the theme from the movie Rocky III. They followed with four more top ten hits, High on You (1985 / #8), The Search is Over (1985 / #4), Burning Heart (1985 / #2) and Is This Love (1986 / #9).
