Eric Dane has filed a lawsuit against Smashing Pumpkins frontman Billy Corgan.

The Grey’s Anatomy actor, who lives next door to the rocker in Beverly Hills, claims a falling tree on the musician’s property nearly killed his pregnant wife, Rebecca Gayheart.

TMZ reports Eric filed suit in Los Angeles Superior Court.

According to the website, the actor alleges one of the Billy’s eucalyptus trees crashed through the couple’s home during a storm last year, causing serious flooding and breaking a power line.

Rebecca was nine months pregnant at the time.

The suit asserts the couple was forced to evacuate while manoeuvring around high-voltage wires. It also states that Billy had been warned about the potential danger before the incident but failed to remove the trees.

Billy, 45, denies the claims.

“I was horrified when I learned about the tree falling during what was a massive storm, a storm with winds strong enough to uproot a 50ft tree by its base! Thankfully no one was injured,’ he told the website.

The musician also said he had similar trees removed from his property following the incident and called the lawsuit ‘a shame’.

Eric and Rebecca are suing for nuisance, negligence, and injunctive relief.

The couple is reportedly seeking unspecified damages in the case.
