The members of the Velvet Underground were dealt a partial blow in their suit against the Andy Warhol Foundation over the licensing and use of the iconic Warhol banana used on their album The Velvet Underground and Nico. The foundation has recently been licensing Warhol's work for use on a number of products, including to Apple in association with their iPad and iPod products. The Velvet Underground, whose former members include Lou Reed and John Cale, claim that the painting has become so identified with the group that its use elsewhere would be confusing to consumers. On Friday, a federal judge refused to hear a claim of copyright on the image, but that doesn't mean the case is over. It now moves to a new phase that will reexamine the claims from a trademark standpoint.
